By accessing or using the HowUdish mobile application and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and HowUdish. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

Description of Service

HowUdish provides a mobile application that offers:

Restaurant menu scanning and analysis
Meal ranking based on protein density and nutritional factors
Fasting state optimization recommendations
Meal tracking and performance insights
Premium subscription features including unlimited tracking and advanced analytics

The Service is designed to provide general wellness guidance and is not intended to replace professional medical advice, diagnosis, or treatment.

The information provided by HowUdish is for general wellness guidance only. It is not intended to be, and should not be interpreted as, medical advice, diagnosis, or treatment.

HowUdish does not provide medical advice. The meal rankings, nutritional information, and fasting recommendations are based on general dietary principles and should not be considered medical guidance.

You should always:

Consult with a qualified healthcare provider before making any dietary changes
Seek professional medical advice if you have any health concerns or conditions
Not disregard professional medical advice or delay seeking it because of information from HowUdish
Understand that individual nutritional needs vary based on health status, activity level, and other factors

HowUdish is not responsible for any health outcomes resulting from use of the Service. Use of the Service is at your own risk.

User Responsibilities

As a user of HowUdish, you agree to:

Provide accurate and complete information when creating your account
Maintain the security of your account credentials
Use the Service only for lawful purposes and in accordance with these Terms
Not attempt to reverse engineer, decompile, or disassemble any part of the Service
Not use the Service to transmit harmful code or interfere with its operation
Not share your account with others or allow unauthorized access
Be at least 18 years of age to use the Service
Take responsibility for your own dietary and health decisions

Subscription and Billing

Free Plan

HowUdish offers a free plan with limited features, including 8 meal scans per month and basic ranking functionality.

Premium Subscription

The Premium subscription is billed monthly at the rate displayed in the app at the time of purchase. By subscribing to Premium, you authorize us to charge your payment method on a recurring monthly basis.

Automatic Renewal

Your Premium subscription will automatically renew each month unless you cancel before the renewal date. You will be charged the then-current subscription rate.

Cancellation

You may cancel your Premium subscription at any time through your account settings or the App Store. Cancellation will take effect at the end of your current billing period. You will retain access to Premium features until the end of the paid period.

Refund Policy

All subscription fees are non-refundable except as required by law. We do not provide refunds or credits for partial months of service, or for periods in which you did not use the Service.

Price Changes

We reserve the right to change subscription prices at any time. Price changes will apply to new subscriptions and renewals after the change takes effect. We will provide advance notice of any price changes.

Intellectual Property

The HowUdish Service, including all content, features, functionality, software, algorithms, and design, is owned by HowUdish and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. This license does not include:

Any right to reproduce, distribute, or create derivative works
Any right to reverse engineer or extract source code
Any right to use the Service for commercial purposes
Any right to remove or modify proprietary notices

User Content

You retain ownership of any content you submit to the Service, including menu photos and meal tracking data. By submitting content, you grant HowUdish a worldwide, non-exclusive, royalty-free license to use, process, and analyze such content solely for the purpose of providing and improving the Service.

You represent and warrant that you have all necessary rights to submit content to the Service and that such content does not violate any third-party rights or applicable laws.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOWUDISH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL HOWUDISH'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO HOWUDISH IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

HOWUDISH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOU USE THE SERVICE AT YOUR OWN RISK.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to:

Violation of these Terms
Fraudulent or illegal activity
Abuse of the Service or other users
Non-payment of subscription fees

Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time through the account settings.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which HowUdish is registered, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property infringement.

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely matches the intent of the original provision.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HowUdish regarding the Service and supersede all prior agreements and understandings, whether written or oral.
